Section 5 Interpretation.
Disclosure statement now required to incorporate Schedule 1A where the fiscal implications

Section 10 Retirement Village to be registered
A Retirement Village is required to be registered . - when registered it will be required to
conform to the Act especially the schedules.
Section 12 Registration of existing villages
to be done within 6 months from the day section 10 comes into force.Then there is an
Obligation to issue residents with disclosure statement that complies with the Act.
Section 26 Occupation Rights agreement.
Intending residents must receive independent legal advice before signing the occupation
agreement and signature on the agreement must be witnessed by a lawyer who must explain the
general effect of the agreement and its implications.
Section 27 Cooling off period and cancellation for delay
Cooling off period has been increased to 15 working days and cancellation of the agreement
within this time to be in writing.
Section 28 Deposits and other payments must be independently held
Any deposit to be held in an interest bearing deposit.
Section 29 Informatioon to be supplied
Before any occupational agreement is entered into the intending Resident must
receive a disclosure statement that complies with Schedule 1A
Section 29A Occupational right agreement voidable
Occupational agreement is voidable if in contravention of suspension of registration ,
advertising unregistered villages , requirement to supply disclosure statement and/or
code of rights and/or copy of occupation rights agreement
Also specifies refund , interest & costs resident is entitled to receive.
Section 30 Retirement Villages to have code of residents' rights
Code of Resident's rights in schedule 3 to be a summary of the minimum rights.
Section 36 Registrar must approve statutory supervisor
Register now approves the statutory supervisor
Operator must appoint a statutory supervisor unless an exemption recommended by Minister.

or facilities planned:
(c) charges of all kinds, including (without limitation)-
(d) provision made for maintenance and refurbishment at the retirement village:
(e) the preparation, auditing, and disclosure of financial
accounts for the retirement village.
(a) the cooling-off period and the right to cancel for delay provided by section
27 of the Retirement Villages Act 2001, and any additional cooling-off period or
right to cancel for delay given by the occupation right agreement:
(b) whether the operator or a resident can vary an occupation right agreement and if
so in what circumstances:
(c) the arrangements for termination of an occupation right agreement, including
(without limitation)-
(d) deductions from payments made by or due to residents, including (without limitation)-
(e) the estimated financial return that a resident, former resident, or the estate of a
former resident, could expect to receive on the sale or other disposal of a vacant
residential unit; including (without limitation)-
(a) disclose whether any holder of a security interest to whom section 12(1)(ab)
applies has refused to consent to the registration of the village; and
(b) contain all prescribed details of any exemption from the
requirement to comply with a provision or provisions of 25 the code of practice; and
(c) contain any other matters required to be included in the statement by the code of
practice or any regulations made under the Retirement Villages Act 2001.
Required information and provisions

(b) any provision in the code of practice, unless the operator is exempt from the
requirement to comply with that provision.
Matters to be included in code of practice
(a) the qualifications and experience of staff at each retirement village:
(a) the manner in which the physical environment and management practices at each
retirement village must maintain and enhance the physical safety and security of
residents (including those with disabilities):
(a) requirements relating to the protection of residential village units and
retirement village facilities from fire:
(a) requirements about the transfer of residents from independent self-care units
to parts of the retirement village providing greater care:
In case of sale of vacated unit the panel must take into account
defines what the dispute panel can order for 41 1A
Clause (4) is added to make an
order made by dispute panel enforceable in law.
Code of Practice approved by Minister will be applicable to all Retirement Villages.
If no code Of Practice submitted by any retirement village or association/group of
retirement villages is acceptable to the Minister then the Minister will publish a

The code of practice must specify minimum requirements to be included in any
occupation right agreement in relation to the following topics.1 Staffing of retirement village
The matters that must be addressed in the code of practice are-
(b) arrangements for the training and ongoing supervision of those staff. 2 Safety and personal security of residents
The matters that must be addressed in the code of practice are-
(b) the circumstances in which a retirement village can use the personal security
of intending residents or residents as a promotional feature in its advertising, and
if this is permitted, requirements to ensure that security is maintained at levels
featured in any promotional material.3 Fire protection and emergency management
The matters that must be addressed in the code of practice are-
(b) requirements relating to plans, instructions, and equipment for dealing with
fire and other emergencies:
(c) requirements relating to insurance cover for residential units and retirement
village facilities and units for fire and accidental damage:

The matters that must be addressed in the code of practice are-
(a) the grounds on which an occupation right agreement may be terminated by the
operator of the retirement village or a resident:
(b) the process that must be followed by the operator or resident before exercising
any right to terminate an occupation right agreement:
(c) requirements relating to payments due when an occupation right agreement is
terminated and the manner in which those amounts are calculated, including-
(i) the period for which charges will continue to be imposed after termination:
(ii) the relationship between those charges ongoing costs
(iii) the operator's responsibilities in relation to the sale or other disposal of a
residential unit made vacant as a result of the termination:
(iv) the rights of the former resident or the estate of the former resident in
relation to the sale or other disposal of a unit made vacant as a result of the termination.9 Communication
The matters that must be addressed in the code of practice are requirements in relation
to communication by the operator of a retirement village with residents or intending
residents for whom English is a second language or whose ability to communicate is limited.
