Below is our contract, which outlines the basic terms of engagement.

This
agreement outlines basic conditions of acceptance by the “PURCHASER” and
service provided by the “ENTERTAINER” collectively known as ‘NEMESIS’.
1. Service
to be paid in full at the duration of that service as agreed prior to the
hiring of the entertainer.
2. Tax,
Withholding tax is paid by the
“Entertainer” not by the “Purchaser” all payment for the service by the
Purchaser is NET, the “Purchaser” on our behalf forwards Tax to the IRD. (20%)
3. The
Entertainer to play “four” one-hour brackets with breaks of ten minutes
duration between brackets.
4. If the purchaser ends the gig early Payment
in full is still applicable. If the entertainer ends the gig early (illness
gear failure etc) payment to the nearest half hour is applicable.
5. If
the purchaser wants the entertainer to play for a longer period exceeding the
four-hour period a further charge of $100.00 for every hour there after will be
encored.
6. Cancellation
by the “Purchaser” must be given 14 days prior to the agreed date of the
performance. A fee of $400.00 will apply if failure to meet these conditions.
These conditions will not apply if the “Purchaser” has had an “act of god”
fire, or closure of premises.
7. The
agreement of the Entertainers to perform is subject to proven detention by
legitimate conditions beyond their control.
8. Accommodation
for four persons to be provided or arranged by the “Purchaser” if the
travelling time to the performance venue exceeds a two-hour duration.

9. The
“normal” start and end time of performance to be either “8pm to 12am or 9pm to
1am”. If the “Purchaser” requires the “Entertainer” to perform outside these
times, the “purchaser” must specify the start and end time at the time the
service is booked or 14 days prior to the “performance”.
10. Security.
The Purchaser is to provide adequate security at the venue.
11. POWER:
We will need at least two power outlets.
12. “Excessive
noise”. If the “Purchaser” has complaints from neighbouring residents or
patrons the “entertainer” will agree to turn down to a reasonable level. The
“purchaser” shall endeavour to keep doors and windows closed where practical to
control “Excessive noise” if complaints are received.
13. The
“Entertainer” will pack down band equipment and lighting as soon as practical
after the “performance.”
The “Purchaser”
must contact the “Entertainer” within seven days of receiving the contract, If
the need for alteration to the contract arises. Failure to do so will mean
acceptance of the “Contract” by the “Purchaser”.
